These Terms of Service (“Terms”) govern your access to and use of the Phrazed mobile application and related services (the “Service”), which is provided by Freeroll, LLC solely for entertainment purposes. By accessing or using the Service, you acknowledge that you are being granted a limited, non-exclusive right to use the app for its intended purpose, and you expressly agree to abide by and be bound by these Terms in their entirety.
I. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.
II. Accounts & Authentication
Access to the Service may require signing in through a third-party authentication provider (such as Apple, Google, or Facebook). You are responsible for maintaining the security of your account and for all activity that occurs under your account.
III. User-Generated Content
You retain ownership of content you submit through the Service. However, by submitting content or prompting AI-generated results, you grant Phrazed a worldwide, exclusive, royalty-free, perpetual, and sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from your content for purposes of operating, improving, and promoting the Service, including the creation and sale of physical or digital merchandise for profit without further compensation to you. You specifically consent to the processing of your submissions by third-party AI providers (AWS Bedrock) for the purpose of game generation and scoring.
You acknowledge that any names, images, or likenesses generated through the Service are the result of user-initiated prompts and are derived from publicly available data. Phrazed is an entertainment platform and does not use third-party brands to commercially sell products or imply any official affiliation, endorsement, or partnership with any real-world brand, entity, or person that may inadvertently appear in user-generated results.
We reserve the right to remove or moderate content at our discretion and are not liable for any infringing or offensive content created by users through the use of the Service.
IV. In-App Purchases & Virtual Items
The Service may include virtual items or features available for purchase (“Virtual Items”).
- Virtual Items have no real-world monetary value
- Purchases are final and non-refundable, except as required by law
- Refunds are handled by the app store through which the purchase was made
- Virtual Items are non-transferable
- We may modify or discontinue Virtual Items at any time without liability
V. Advertising & Third-Party Services
The Service may display advertisements and include links or integrations with third-party services. We are not responsible for third-party content, services, or practices.
VI. Prohibited Conduct
You agree not to:
- Cheat, exploit, or manipulate gameplay
- Harass or abuse other users
- Upload unlawful or offensive content
- Reverse engineer or attempt to disrupt the Service
- Use the Service for any illegal purpose
VII. Account Deletion
You may initiate the permanent deletion of your account at any time through the App Settings. Upon initiation, your personal profile data (including your email, username, and authentication connections) will be permanently destroyed. You acknowledge and agree that your gameplay contributions (such as uploaded phrases, generated images, and match scores) will be stripped of your identity, assigned to an anonymized system profile, and retained indefinitely to maintain the functional integrity of the game's multiplayer ecosystem.
Deletion of an account results in the immediate and permanent forfeiture of all Virtual Items, stats, and account progression with no right to refund. While your account is locked immediately, please note that it may take a brief processing period for your username and personal identifiers to be fully scrubbed from all shared game content and historical match records.
VIII. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, access to Virtual Items may be lost without refund.
IX. Disclaimers
The Service is provided “as is” and “as available.” We make no warranties regarding availability, accuracy, or reliability, including any AI-generated or user-generated content.
X. Limitation of Liability
To the maximum extent permitted by law, Phrazed shall not be liable for any indirect, incidental, or consequential damages related to your use of the Service, including but not limited to any offensive, inappropriate, or infringing content generated by AI or other users. Our total liability shall not exceed the amount you paid to us in the past twelve months, or $100, whichever is greater.
XI. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.
XII. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
